This week’s blog post is a memorandum Spencer King of King and Jurgens prepared for RPC describes differences between Louisiana and federal law on expert discovery. As Texas law on expert discovery follows federal law, it also describes the differences between Louisiana and Texas law.

A key point from the memo is, unlike federal law, drafts of expert reports and communications between experts and attorneys are generally discoverable in Louisiana. The range of documents experts are required to produce is wider under Louisiana law. There are other differences attorneys who do not often practice in Louisiana will want to know.

RPC will be conscious of the differences when providing expert services for Louisiana cases. We think this memorandum has much valuable information and we hope it benefits our readers.
